4. Products & Availability

All products are subject to availability. We reserve the right to limit quantities, discontinue products, or modify product descriptions at any time without prior notice.
Product images are for illustrative purposes only. Colors and appearance may vary depending on screen settings.

5. Ordering & Processing

Placing an order constitutes an offer to purchase. An order is only accepted once payment has been successfully received and confirmed.
Once payment is completed, orders are typically sent to production within hours. Cancellations or changes may not be possible after this point. If you need to request a change, you must contact us immediately via email. We do not guarantee that changes can be made.

6. Pricing & Payments

All prices displayed are in euros (€) and include VAT where applicable, unless stated otherwise.
Payment must be made using the payment methods available at checkout.
If a payment fails, is reversed, or is made using incorrect currency or information, the order may be delayed or cancelled until resolved.

7. Shipping & Delivery

Shipping and delivery terms are governed by our Shipping Policy.
Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control.
Risk of loss passes to the customer once the order has been handed over to the carrier.

8. Returns & Refunds

Returns and refunds are governed by our Return Policy.

Returned items must be unused, unworn, and in their original condition, including original packaging where applicable.
Return requests must be submitted in accordance with the conditions and timeframes stated in our Return Policy.

Unless explicitly stated otherwise, return shipping costs are the responsibility of the customer.
Refunds, if approved, will be processed using the original payment method.

9. Intellectual Property

All designs, logos, graphics, text, images, and other content on the Website are the exclusive property of Genesis Apparel or its licensors.
You may not copy, reproduce, distribute, modify, or use any content without prior written permission.

10. Product Use & Safety

Our products are garments intended for normal wear and must be handled according to the provided care instructions.
Genesis Apparel is not liable for damage, injury, or loss resulting from improper use, washing, alteration, or modification of products after delivery.

You agree not to use the Website or Services for any unlawful purpose, including but not limited to fraud, infringement of intellectual property rights, distribution of malware, or abuse of the Website or its users.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Our liability is limited to the purchase price of the product in question.
  • Genesis Apparel shall not be liable for indirect, incidental, special, or consequential damages, including loss of profit, revenue, or data.
    Nothing in these Terms limits liability where such limitation is prohibited under Dutch or EU law.

13. Privacy & Data Protection

We collect and process personal data solely for order processing, customer service, and legal obligations.
We do not sell customer data to third parties.

14. Third-Party Services (Shopify)

Our Website is hosted by Shopify. Purchases are made directly with Genesis Apparel.
Shopify is not responsible for any aspect of the sales transaction between you and us.

15. Amendments

Genesis Apparel reserves the right to modify these Terms at any time.
The version in effect at the time you place your order will apply to that order.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17. Governing Law & Jurisdiction

These Terms are governed by the laws ofthe Netherlands.
Any disputes shall be submitted exclusively to the competent courts in the Netherlands.
